1. Acceptance of Terms

By downloading, installing, or using the HortiWise application (“App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the App.

2. Description of Service

HortiWise is a plant care companion application for iOS and Android devices that allows users to:

  • Create and manage plant profiles with care schedules and reminders
  • Capture and store plant photos locally on the device
  • Identify plants and run health checks using AI-powered visual analysis
  • Receive weather-based watering and care suggestions
  • Use voice commands to interact with garden features (where available)
  • Keep a garden journal with notes and photos
  • Share plant achievements via the system share sheet
  • Subscribe to premium features through in-app purchases

HortiWise does not operate backend servers to store your garden data. Most features work with data stored locally on your device.

3. User Responsibilities

3.1 Appropriate Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You are responsible for:

  • Maintaining the security of your device and App access
  • Ensuring content you create (photos, journal entries) is appropriate and lawful
  • Not attempting to reverse engineer, decompile, or modify the App
  • Using the App for personal plant care purposes only

3.2 Content Ownership

You retain full ownership of all plant photos, journal entries, and other content you create using the App. HortiWise does not claim ownership rights over your personal content. Photos are stored on your device and are not uploaded to HortiWise servers.

4. Privacy and Data

4.1 Local-First Architecture

HortiWise is designed without a proprietary backend. Your plant profiles, journals, photos, and care history are stored locally on your device. We do not operate servers to collect or permanently store your garden content.

4.2 Limited Third-Party Processing

Certain features require internet access and third-party services:

  • AI analysis: When you tap Identify or Health Check, photos are temporarily sent to Alibaba DashScope for processing.
  • Weather: Location, postal code, or IP-based approximation is sent to weather providers solely to fetch forecasts.
  • Analytics and ads: Firebase and Google AdMob may process usage and device data as described in our Privacy Policy.

4.3 Data Security

We recommend:

  • Using device security features (passcode, Face ID, fingerprint, or equivalent)
  • Keeping your operating system updated
  • Backing up your device if you want to preserve local garden data

5. AI Features

5.1 Plant Identification and Health Check

The App provides AI-powered plant identification and health analysis through Alibaba DashScope (Qwen VL models). This analysis:

  • Requires an internet connection
  • Processes only photos you actively submit by tapping Identify or Health Check
  • Returns results to your device for local storage
  • Does not permanently store your photos on HortiWise servers

5.2 Voice and Care Advice

Where available, voice commands and AI-generated care plans may send transcribed text or prompts to DashScope. These features are initiated by your interaction with the App.

5.3 Accuracy Disclaimer

AI results are provided for informational and educational purposes only. Identification, health scores, and care recommendations:

  • May not always be accurate or complete
  • Should not be treated as professional botanical, agricultural, or medical advice
  • Are not a substitute for consultation with qualified plant specialists, arborists, or extension services

HortiWise is not a medical or professional horticultural device. Always use your own judgment and seek expert advice for serious plant health issues.

6. Subscription and In-App Purchases

6.1 Purchases

HortiWise offers optional premium subscriptions (monthly and yearly). All purchases are processed through:

  • Apple App Store (StoreKit) on iOS
  • Google Play (Google Play Billing) on Android

Payment terms, billing, and receipts are governed by Apple’s or Google’s applicable policies. HortiWise does not collect or store your payment card information.

6.2 Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the current period ends. Your account will be charged for renewal within 24 hours prior to the end of the current period.

You can manage or cancel subscriptions through:

  • iOS: Settings → Apple ID → Subscriptions
  • Android: Google Play Store → Payments & subscriptions → Subscriptions

6.3 Free Trials and Pricing

If a free trial is offered, any unused portion is forfeited when you purchase a subscription. Prices may vary by region and are displayed in the App at the time of purchase.

6.4 Refunds

Refund requests for subscriptions or in-app purchases must be directed to Apple or Google through their respective support channels. HortiWise cannot process refunds directly.

6.5 Restore Purchases

You may restore previous purchases using the Restore option on the subscription screen, subject to Apple or Google verification.

7. Advertising

Free users may see advertisements served by Google AdMob, including rewarded video ads that unlock temporary premium features and app-open ads. Ad serving is subject to Google’s advertising policies. Premium subscribers may have reduced or no advertising, as described in the App.

8. App Updates and Maintenance

8.1 Updates

The App may update automatically or prompt you to update to deliver new features, security improvements, and bug fixes.

8.2 Service Availability

We strive to maintain App functionality but cannot guarantee uninterrupted service due to:

  • Device or OS compatibility issues
  • Network or connectivity problems
  • Maintenance or updates to third-party services (DashScope, weather APIs, Firebase, AdMob)
  • App store policy or billing changes

9. Limitation of Liability

To the maximum extent permitted by applicable law, HortiWise and its developers shall not be liable for:

  • Loss of locally stored data or content
  • Interruption or unavailability of the App or third-party services
  • Plant damage, crop loss, or care decisions made based on App suggestions or AI results
  • Inaccurate identification, health scores, or weather forecasts
  • Any indirect, incidental, special, or consequential damages

The App is provided “as is” without warranties of any kind, express or implied, including fitness for a particular purpose or accuracy of AI-generated content.

10. Termination

You may stop using the App at any time by uninstalling it. These Terms remain in effect while you use the App. We may discontinue the App or certain features with reasonable notice where practicable.

11. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes are posted constitutes acceptance of the updated Terms. Material changes may also be communicated through the App or our website.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which the App developer operates, without regard to conflict of law principles. Any disputes shall first be attempted to be resolved through good-faith contact at the email above.
